Florida has two late penalties, not one — and we had it wrong until last week
We published “1.5% per month or 10%, whichever is greater” for months. Reading the statute properly, those are two separate penalties for two separate failures. Here is the correction.
The correction
Florida Statutes §576.041 sets out two penalties. If you do not pay the inspection fee, it is 1.5% for each month or part of a month on the unpaid amount. If you do not file the report, or file a false one, it is 10% or $25, whichever is greater. We had previously collapsed those into a single “1.5% monthly or 10%” line, which is wrong: they punish different failures and can both apply.
Why we are telling you
Because a rule library that silently fixes its own mistakes is worth less than one that says what it got wrong and when. Every state page here carries the date it was last reviewed. This one changed on 4 September 2026.
While we were in the statute
We also closed two gaps that had been showing as “not verified” on the Florida page. The distribution licence is $100 and specialty fertilizer registration is $100 per product, both expiring 30 June each year, under §576.021.
What Florida still costs
$1.00 per ton, or 30 cents for untreated phosphatic materials and certain others, reported quarterly within 30 days of the close of the period.
